This Agreement is entered into by and between You (Participant) and Tonya Baynes (Coach) for participation in The Dare Club group coaching program.
1. PROGRAM, FEES AND PAYMENT
This Agreement covers Participant's place in The Dare Club, a six to eight week group coaching program consisting of eight weekly group calls of 90-120 minutes, one assigned personal challenge each week, access to a private group thread, and program materials.
The round dates, call day and time, and the program fee are those stated on the enrollment page at the time Participant enrolled, and in the confirmation email Participant received. Those terms are part of this Agreement as if written here in full.
By signing below, Participant confirms they have reviewed those terms and agree to them.
Payment. Payment is due in full before the first call unless a payment plan has been agreed in writing. If a scheduled payment does not clear, access to calls and the group thread pauses until payment is current.
2. WHAT IS INCLUDED
Six to eight weekly group calls of ninety minutes, led by Coach.
One assigned personal challenge each week.
Access to a private group thread for the duration of the program.
Program materials and worksheets.
What is not included. Individual coaching, one on one sessions, or private support from Coach between calls. Participants who want individual work may ask about one on one coaching separately.
3. THE NATURE OF GROUP COACHING
Group coaching is different from one on one coaching in ways worth naming up front.
Coach's attention is shared across the group. Not every participant will be coached directly on every call.
Much of the value comes from the other participants. What they share, what they attempt, and what they report back is part of the program.
Coach is not a licensed therapist or physician and is not trained in diagnosing psychological or medical conditions. This program is not therapy, counseling, or medical care.
Coach cannot guarantee results. Results come from participating fully, attempting the dares, and being honest in the group.
4. CONFIDENTIALITY, AND ITS LIMITS
Please read this section carefully. It is the most important difference between group and one on one work.
Coach's commitment. Coach will not disclose information shared by any participant without that participant's written consent, except where there is an imminent or likely risk of harm to a participant or others, or illegal activity.
What Coach cannot promise. Coach cannot control what other participants do with what they hear. Every participant agrees to the group commitment below, and Coach will enforce it as far as she is able, but Coach cannot guarantee it.
Share accordingly. Participants are asked to bring real things to this group, and also to use their own judgment about what is theirs to share in a room of people they are still coming to know.
The group commitment. By signing, Participant agrees:
What is shared in calls and in the group thread stays in the group.
Participant will not record, screenshot, or forward any part of a call or thread.
Participant will not share another participant's name, story, or details outside the group, including in private conversation.
Participant will not contact another participant outside the program without that person's agreement.
A participant who breaks this commitment may be removed from the program without refund.
5. ATTENDANCE AND RECORDINGS
Calls happen at the scheduled time whether or not every participant attends. Missed calls are not rescheduled, refunded, or made up individually.
Calls may be recorded and shared with the group only, so participants who miss a call can catch up. Recordings are deleted within sixty days of the program ending.
Participants who do not wish to appear in a recording may keep their camera off and will not be called on by name while recording.
6. THE DARES
Each week participants are assigned or choose a dare. Dares are things participants have been avoiding, chosen to stretch comfort zones.
Participants choose their own dares and are solely responsible for them. Coach does not direct, supervise, or take responsibility for what a participant decides to do outside of calls.
Participants agree not to choose dares that are illegal, that endanger themselves or others, or that would require medical clearance they do not have. Coach may decline to support any dare at her discretion.
Nothing in this program is a direction to do anything unsafe. If a dare involves physical activity, Participant is responsible for determining whether they are able to do it safely and for seeking medical clearance where appropriate.
7. CANCELLATION AND REFUNDS
Before the program starts. Participant may cancel up to seven days before the start date for a full refund.
After the program starts. Within seven days of the first call, Participant may request a refund of half the fee. After that point, no refunds are given. Because the group size is limited and the spot is held, the full fee is owed whether or not Participant attends.
If Coach cancels the program or does not deliver the stated number of calls, Coach will refund the fee for any calls not delivered.
Transfers. A spot may be moved to a future round once, at Coach's discretion, if requested before the second call.
8. REMOVAL FROM THE PROGRAM
Coach may remove a participant, without refund, for breaking the group commitment in Section 4, for conduct that makes the group unsafe or unproductive for others, or for repeated non payment.
Coach will give written notice and, where appropriate, one opportunity to address the issue first.
9. MATERIALS
All worksheets, prompts, frameworks, and other materials provided by Coach remain the property of Coach. They are for Participant's personal use and may not be copied, distributed, sold, or taught to others without written permission.
10. STORIES AND TESTIMONIALS
Coach may ask Participant for a testimonial at the end of the program. Nothing is shared without the permission marked below, and permission can be withdrawn at any time in writing.
Founding round. Participants in the founding round at the reduced rate agree to provide a written testimonial within thirty days of the program ending. This is part of the consideration for the reduced rate.
11. LIMITATION OF LIABILITY AND INDEMNIFICATION
Participant acknowledges that results are subjective and vary. Coach makes no warranties, express or implied, in connection with the services provided.
Participant agrees to indemnify, defend, release and hold harmless Coach from and against any and all costs, losses, claims, damages, liabilities, expenses and other obligations, including reasonable attorneys' fees and costs, asserted or recovered against or incurred by Coach in connection with the services proposed or provided under this Agreement, including anything arising from a dare or activity Participant chooses to undertake.
12. GOVERNING LAW AND ENTIRE AGREEMENT
This Agreement is governed by the laws of the State of Delaware.
This document reflects the entire agreement between Coach and Participant and supersedes all prior written and oral representations. It may not be amended except in writing signed by both parties.
